FMCs clomazone and bifenthrin under patent in Brazil

FMC continues to market its herbicide, clomazone, and its insecticide, bifenthrin, under patents in Brazil until 2014. Brazilian authorities granted registrations to Makhteshim-Agan Industries Brazilian subsidiary, Milenia, for its generic equivalents earlier this year (Agrow No 530, p 18). Applicants cannot manufacture or sell generic equivalents that are patent protected, but can carry out tests, Tulio Oliveira of the Brazilian generic agrochemical industry association, the AENDA said. The government is obliged to grant the registrations, he added. FMC received ten-year patents for the active ingredients in 2004 and will continue to invest in them through new formulations, mixtures and alliances, it says.
