BASF SE filed patent-infringement complaints with the U.S. International Trade Commission and in Delaware federal court against Sharda Cropchem Ltd., seeking orders blocking imports and sales of a fungicide used as a seed treatment on corn and soybeans.
Sharda, based in Mumbai, “plans to market and sell” in the U.S. what’s already sold abroad as Preach, the complaints say. BASF alleges that the product and the method by which it’s made infringe a patent for a crystalline modification of the fungicide, pyraclostrobin, that’s well suited for preparing crop-protection compositions and aqueous suspension concentrates.
