China's Jiangsu Higher Peoples Court has ruled against Chinese agrochemical company Shouguang Shuangxing (Shandong) and its distributor in Jiangsu in a case brought by BASF. The Court found the company guilty of offering three products containing BASFs patented insecticide active ingredient, chlorfenapyr. The Chinese company was ordered to: destroy all infringing products; cease the production and offer of the patented products without BASFs authorisation; and pay "appropriate" damages in addition to BASFs litigation costs.
BASF has been quite active in pursuing cases of patent infringement of chlorfenapyr. In September 2007, Chinas Nanjing Intermediate Peoples Court ruled in favour of BASF against a dealer selling chlorfenapyr. In October 2007, BASF got two Chinese companies evicted from the BCPC Congress in Glasgow, UK, for infringing UK proprietary ais, including the insecticides, chlorfenapyr and fipronil.
BASF also won an infringement against a Brazilian company in February for infringing its Brazil patented insecticide, fipronil.
